The Missouri Human Rights Commission

The Missouri Human Rights Commission investigates complaints of employment discrimination and other forms of discrimination.

Charge of Discrimination

When an employee has been discriminated against in the workplace the first thing he or she should do is contact an experienced attorney to discuss their case. After contacting an attorney he or she will advise you whether you have a case and if you do your attorney will help you file a charge of discrimination with the Missouri Human Rights Commission.

A charge of discrimination is a standard form on which an employee names the employer, the type of discriminatory action taken, the dates of discrimination, and a short statement regarding the nature of the charges.

Right to Sue Letters

Once the Missouri Human Rights Commission has reviewed the charge it will provide notification that a case has been opened. At that point, the attorney would request a 'right to sue letter' from the Commission.

A right to sue letter is simply a statement from the Missouri Human Rights Commission that the employee has filed a charge of discrimination and that the employee has a right under the laws of the State of Missouri to file an employment discrimination lawsuit in circuit court.

Federal Employment Discrimination - Equal Employment Opportunity Commission

Much like the Missouri Human Rights Commission, the federal Equal Employment Opportunity Commission (EEOC) investigates complaints of workplace discrimination. The EEOC mandate is specified under the following federal laws:

  • Title VII of the Civil Rights Act of 1964
  • Age Discrimination in Employment Act of 1967
  • Rehabilitation Act of 1973
  • Americans with Disabilities Act of 1990
  • ADA Amendments Act of 2008

Both the Missouri and federal laws overlap in their protections against workplace discrimination. The process of filing a charge of discrimination with the commission, receiving a right to sue letter, and filing a petition in federal court closely mirrors the process under Missouri law. However, the Missouri statutes and courts are considered the friendliest venue in which to bring a claim of employment discrimination. For this reason, a majority of workplace discrimination claims in Missouri are brought in state court rather then in federal court.
