Your employer must pay time-and-a-half for all hours worked above and beyond 40 hours per workweek. Whether you are entitled to overtime pay may depend on the classification of your employment, the classification of your workweek and other factors.

Non-Exempt Employees

Non-exempt employees are entitled to overtime pay. An employee's actual job duties, not the advertised job title, determines who is exempt and who is non-exempt from overtime pay.

Salaried Employees

Salaried employees are not automatically exempt and may be entitled to recover overtime pay.

Exempt Employees

Exempt employees are not eligible to receive overtime pay. These types of employees and job duties fall under the following categories:

  • Administrative exemption
  • Executive exemption
  • Professional exemption
  • Outside sale exemption
  • Computer employee exemption

Misclassified Employees

Employers might misclassify employees in an an attempt avoid paying the overtime rate. Some employers will misclassify an employee as a manager even though the employee performs the same job duties as the people they manage.

Fair Labor Standards Act (FLSA) and Missouri Labor Laws

The FLSA provides that employers must pay at least one and one-half times the employee's regular rate once overtime pay is in effect. Federal and State of Missouri laws do not allow employees to waive their rights to overtime pay or accept the regular pay rate instead. Missouri labor laws also require employers to compensate employees for the actual number of hours worked.
